two prisoner letters detail racially biased and unjust legal process during pandemic

Letter One

Hello Supreme Court of California,

My name is Mr. Eric Wayne, a temporary housed inmate housed at Santa Rita Jail, in Dublin, CA (Alameda County).

The population here in Santa Rita Jail in Dublin, CA continues to climb daily and nobody is being released at all. Inmates’ rights continue to be violated. Court dates is being waived without no clients’ consent, inmates is not receiving no attorney visits at all, judges is denying Humphrey releases to most people that fit the criteria, motions with tremendous violations is being denied in most courtrooms……

As you see, the coronavirus continues to erupt in the whole world and the whole Bay Area. The population here in Santa Rita Jail in Dublin, CA continues to climb daily and nobody is being released at all. Inmates’ rights continue to be violated. Court dates is being waived without no clients’ consent, inmates is not receiving no attorney visits at all, judges is denying Humphrey releases to most people that fit the criteria, motions with tremendous violations is being denied in most courtrooms, accused defendants that’s been in custody for a long period of time such as myself is being denied full discovery from Alameda County Public Defender’s Office, and it’s a lot of people in the same situation here at Santa Rita Jail in Dublin, CA.

People are being over-charged with charges from the District Attorney’s office, local law enforcement agencies in all Bay Area cities is destroying evidence, tampering with evidence, falsifying police documents and reports, destroying body camera footage, failing to fingerprint or retrieve DNA. It’s a lot of people in custody right now that suffer from the above violations and a judge knows that, the DA knows that, the Public Defender knows that.

This system is built to human traffic lives, mostly Black lives. Come see what I see every day in Alameda County. Black lives will never matter in this discriminated world. Help is needed badly in Alameda County and this injustice, bias system.

This system is built to human traffic lives, mostly Black lives. Come see what I see every day in Alameda County. Black lives will never matter in this discriminated world. Help is needed badly in Alameda County and this injustice, bias system. Nobody should have to come back on an appeal – knowing it’s tons of violations that took place. So imagine those kids growing up without a father or mother around due to an unjust, biased, racist system.

This system preys on the weak-minded people. In my situation, I should’ve been home a long time ago. But due to the fact I’m an African-American man, 44 years old, with a record – I stand no chance.

I lost my apartment, my unemployment benefits, my relationship with kids & family, sitting in custody for 21 months with no discovery – a public defender that refuses to do his job and somebody I don’t trust at all.

Mr. Eric Wayne

Letter Two

Hello, my name is Mr. Eric L. Wayne, PFN BAK513, and I’m currently housed at the Santa Rita Jail facility in Dublin, CA.

I would like your courts to know about all the violations that are taking place here in Alameda County Superior Courts. Court days is being waived without an accused defendant’s consent, the Humphrey decision that was implemented into the law on 8/26/20, to start releasing pre-trial detainees on ankle monitor with release conditions. That law doesn’t apply in no Alameda County superior courts at all. People of color and those that come from low poverty is being denied the Humphrey law. It will show, that’s why the inmate population is growing fast at Santa Rita Jail.

People of color and those that come from low poverty is being denied the Humphrey law. It will show, that’s why the inmate population is growing fast at Santa Rita Jail….it seems like nobody is being released. It’s 85% of African Americans that’s housed at Santa Rita Jail in Alameda County – the new form of modern day slavery.

Human lives are being human trafficked in Alameda County by the Superior Court judges, the Alameda County District Attorney’s offices, and Alameda County Public Defender’s offices. The 6-foot social distancing policy doesn’t apply here, the mask wearing doesn’t apply here. This information is accurate and truthful.

At least 25 or more are being arrested in Alameda County and it seems like nobody is being released. It’s 85% of African Americans that’s housed at Santa Rita Jail in Alameda County – the new form of modern day slavery. I would like your court to create sources for Alameda County. Also, attorneys from the Public Defenders Office are violating a lot of rights.

It took 16 months to receive 25% of discovery. And be advised that I went to preliminary hearing with no discovery. A lot of people are dealing with the same issues from the Alameda County Public Defenders Office.

Eric Wayne
